The following terms and conditions will be deemed to have been accepted by the User on usage of the website temr.cm. You are requested to read them carefully before You use the services of this site.
The term User shall refer to the user who is browsing the site (interchangeably used with ‘You’). The term Temr shall refer to the company Temr Data registered in the Kingdom of Bahrain. The term Site refers to temr.cm owned and monitored by Temr Data. By using the Site, You agree to follow and be bound by the following terms and conditions concerning your use of the Site. If You are agreeing to use the services on behalf of your company or organization, You agree that You represent the organization and have the authority to accept this agreement on behalf of your organization. Temr may revise the Terms of Use at any time without notice to You. Areas of the Site may have different terms of use posted. If there is a conflict between the Terms of Use and terms of use posted for a specific area of the Site, the latter shall have precedence with respect to your use of that area of the Site.
The software developed for temr.cm is the property of Temr Data. The software of temr.cm is built on top of ERPNext (erpnext.com) which is a general ERP software maintained by FRAPPE Technologies Pvt. Ltd. available under the GNU/GPL licenses and others as specified in their source code. The Services offered by Temr are hosting and support services.
The services will be available to You via the internet browser (specific browsers versions as applicable) and You will need an internet connection to access our services.

Right to Terminate Access

Temr may terminate User’s access at any time for any reason. The provisions regarding to disclaimer of warranty, accuracy of information, and indemnification shall survive such termination. Temr may monitor access to the Site. In case of termination during the subsistence of a subscription period, Temr shall consider refunds, if any on a case to case basis provided the User has adhered to all terms and conditions specified by Temr at the time of purchase. If You have not purchased our services after a specified period, then we have a right to terminate access. We will hold your data for a period of 30 days post termination of access on expiry of subscription of for any reason whatsoever, during which time it may be available for You to download. After this period, we do not guarantee making your data available and bear no responsibility if such data could be lost.

Intellectual Property Rights

All content present on this site is the exclusive property of Temr. The software, text, images, graphics, video and audio used on this site belong to Temr. No material from this site may be copied, modified, reproduced, republished, uploaded, transmitted, posted or distributed in any form without prior written permission from Temr. All rights not expressly granted herein are reserved. Unauthorized use of the materials appearing on this site may violate copyright, trademark and other applicable laws, and could result in criminal or civil penalties. temr.cm is a registered trademark of Temr Data. This trademark may not be used in any manner without prior written consent from Temr Data. The Site, and all content, materials, information, software, products and services provided on the Site, are provided on an “as is” and “as available” basis. Temr expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Changes to Website or to the Agreement

Temr may change or discontinue any aspect of its web site at any time, including, its content or features. Temr reserves the right to change the terms and conditions applicable to use of the Site. Such changes shall be effective immediately upon notice, which shall be placed on the Site. We reserve the right to modify, suspend or discontinue all or any portion of the Site at any time, with or without notice. Unless stated otherwise, any new features to the current Site shall be subject to these Terms of Use. This Site is currently accessible to users without charge, however, we reserve the right to charge users for access to or use of any portion of the Site in the future. These Terms of Use may be modified by Temr at any time with or without prior notice. Any such changes will be posted on the Site. Your continued use of the Site shall be deemed acceptance of any modifications.

Limitation of Damages

Temr and its directors, officers and employees shall not be liable for any direct, indirect, special, incidental, exemplary or consequential damages (including damages for loss of business, loss of profits, litigation or the like) arising out of (a) the use of the site, (b) the content on the site, (c) web sites linked to this site and the content, goods and/or services provided therein (d) any decision made or action taken by You in reliance upon the information within, or content of, the site, and/or (e) the inability to use the site and content contained therein (including, but not necessarily limited to, loss of profits, goodwill or savings, downtime, damage to or replacement of programs and data), whether based in contract or tort (including negligence), product liability or otherwise (but excluding claims arising out of personal injury or death) even if advised of the possibility of such damages. You are responsible for complying with the laws of the jurisdiction from which You are accessing this site and You agree that You will not access or use the information on this site in violation of such laws. You represent that You have the lawful right to submit such information and agree that You will not submit any information unless You are legally entitled to do so. The User’s right to privacy is of paramount importance to Temr. Any information provided by the User will not be shared with any third party unless identified as such elsewhere. Temr reserves the right to use the information to provide the User a more personalized online experience. We host your data at international data centres and the service levels offered by them will be applicable to You. We will reasonably put all effort to ensure that the servers managed by us are up and running 24x7.

The Site may provide links to web sites and access to content, products and services from third parties, including users, advertisers, affiliates and sponsors of the Site. You agree that Temr is not responsible for the availability of, and content provided on, third party web sites. The User is requested to peruse the policies posted by other web sites regarding privacy and other topics before use. Temr is not responsible for third party content accessible through the Site, including opinions, advice, statements and advertisements, and User shall bear all risks associated with the use of such content. Temr is not responsible for any loss or damage of any sort User may incur from dealing with any third party This Terms of Use constitutes the entire agreement between You and Temr with respect to the Site. Temr maintains this site in the Kingdom of Bahrain with some information maybe stored in servers located outside the Kingdom of Bahrain and You agree with these terms of use. The foregoing is subject to the laws of the Kingdom of Bahrain which shall have the exclusive jurisdiction on any dispute that may arise out of the use of this site.

We might collect your name, email, mobile number, phone number, street, city, state, pin code, country and IP address.

Payment and billing information

We might collect your billing name, billing address and payment method when you make a purchase on our website. We NEVER collect your credit card number or credit card expiry date or other details pertaining to your credit card on our website. Credit card information will be obtained and processed by online payment management intermediary such as Benefit or Paypal etc.

Information you post

We collect information you post in a public space on our website or on a third-party social media site belonging to temr.cm.

Demographic information

We may collect demographic information about you, your business and business needs, events you like, events you intend to participate in, conference tickets you buy, or any other information provided by you during the use of our website. We might collect this as a part of a survey also.

We might look at what site you came from, duration of time spent on our website, pages accessed or what site you visit when you leave us. We will share information with the event organizers

We share your information with event organizers and other parties responsible for organizing events, demo sessions for you. The event organizers and other parties may use the information we give them as described in their privacy policies. We may share information if we think we have to in order to comply with the law or to protect ourselves. We will share information to respond to a court order or subpoena. We may also share it if a government agency or investigatory body requests. Or, we might also share information when we are investigating potential fraud. We may share information with any successor to all or part of our business. For example, if part of our business is sold we may give our customer list as part of that transaction. We may share your information for reasons not described in this policy. We will tell you before we do this.

If you click on one of the links to third party websites, you may be taken to websites we do not control. This policy does not apply to the privacy practices of those websites. Read the privacy policy of other websites carefully. We are not responsible for these third-party sites.

What information about me is stored

We only store the information necessary for billing and contact purposes. This will include the following:
  • Your Name (of course)
  • Your Email ID
These are the common information stored with us when you use an temr.cm hosted cloud account. The following information is also stored:
  • Phone number of the primary contact person (if shared by the user)
  • Billing Address (of the company/primary user)

We also store all the data that is requested from you when you signup or request a demo.

Where do you host

We currently host with Amazon Web Service (AWS) whose servers/data centres are located in Bahrain.

What about backups

On the cloud, we maintain regular SQL backups (from hereon referred to as backup) of your account. A backup is taken every day.
These backups are stored on Amazon's AWS service. You can refer to their compliance information at https://aws.amazon.com/compliance/gdpr-center/.

We recommend that you also maintain your own copy. To download them manually by going to Setup > Download Backups.

Who can access my account

We also have an access to your account for administrative purposes. This includes access for support and update purposes. If anyone in our team has to access your data for support, then you will be notified via email, system logs or other mentioning that one of our engineers has accessed your data along with a reason. Your passwords are not accessible to our engineers and are generated via a program. If they need to access the account, they must go via this route. All our employees have signed a Non-Disclosure of Data agreement with us and they are fully aware of the consequences and risks involved with access of customer data.

How do I check all the changes you have made as an Administrator

We will report to you what changes (if any) we have done. At the bottom of each form (or doctypes as we call them) you will see who has made the recent changes. Additionally, you can view the Activity Log Report to track the activities of users in your account. Changes are also made automatically via patches when a new version gets released. In case a patch fails, an Administrator may change your data. In this case too you will be notified of the same.

How do you use my data

Any personal information received will only be used to reply to your queries or fix your bugs (and occasionally send Newsletters which you can opt out of). We do not and never will sell or redistribute your information to any third party.
We do track your visits to the website through Google Analytics. This data is collected anonymously and viewed in an aggregated form to understand the user behavior across companies. The kind of queries we engage with here are like what is the most used transaction in temr.cm, or what do most users do after making a Sales Invoice.

How can I delete all my data that resides with you

We do not sell your data but for your peace of mind you can request to delete your data from our systems. You can email info@temr.cm for data deletion request.
Please note that we can't delete certain details related to billing for legal and auditing purposes.

What if I want to move my data

temr.cm is based on ERPNext which is free and Open Source. This is our biggest advantage against other software with vendor lock-in practices. In the remote possibility that you do not want our service or we are unable to service, the entire source code of ERPNext with installation instructions is online at github.com. All you have to do is download your backup and reinstall on your own server. You will have to manually recreate any customized doctypes and features that were part of temr.cm by editing the code yourself. You can also export only the necessary data you require in spreadsheets (Excel, CSV) and import them in your new ERPNext instance. On the other hand, you can use these spreadsheets or the raw SQL database backup you downloaded to migrate to any other system or software yourself.

Email Opt-Out

You can opt out of receiving or Unsubscribe our marketing emails. To stop receiving our promotional emails, please email info@temr.cm.It may take about ten days to process your request. Even if you opt out of getting marketing messages, we will still be sending you transactional messages through email and SMS about your purchases.

Incorrect/Incomplete Information

If you believe that any information we are holding on you is incorrect or incomplete, please write to or email us as soon as possible, at info@temr.cm. We will promptly correct any information found to be incorrect.

Taking care of your Password (Password security)

temr.cm firmly believes in protecting the personal information of the customer. temr.cm or any of its staff or official will never ask for any password or related information from its customers and the customers are also advised, in order to protect access to their accounts and to other channels, do not disclose the passwords to anyone. Generally, when you subscribe to free trial or make a purchase at temr.cm, you are required to generate your own password. It is recommended that the customers necessarily choose their own passwords carefully such that no unauthorized access is made by a third party. You are also advised not to keep any written or other record of the password/s so that no third party could access the same. You should not disclose the password to anyone. In order that the passwords become complex and difficult for others to guess the you should carefully choose the alpha numeric passwords with combination of upper case alphabets and numbers and special characters (like @, %, &, ! etc.) The password is a private information and must be kept confidential by the owner of the username related to the password. If a password is known by someone other than the owner, that username and password could be misused to access resources and information and possibly with criminal intent—and without notice since they would appear as the registered owner. We will bear no responsibility for loss caused to you in relation to password theft or unauthorized access due to weak passwords etc.

Updates to this policy

From time to time we may change our privacy practices. We may notify you of any material changes to this policy as required by law. We will also post an updated copy on our website. Please check our site periodically for updates.
